Notice procedure

A valid takedown notice under the Digital Millennium Copyright Act must include:

  1. Identification of the copyrighted work claimed to have been infringed.
  2. Identification of the material that is claimed to be infringing, with its location on Come (URL).
  3. Contact information: postal address, telephone and email.
  4. A statement that you have a good-faith belief the use is not authorised.
  5. A statement, made under penalty of perjury, that the information is accurate and that you are authorised to act on behalf of the owner.
  6. Your physical or electronic signature.

Counter-notice

If you believe content removed under a takedown notice was the result of mistake or misidentification, you may submit a counter-notice. The counter-notice must include the same elements listed above plus a consent to the jurisdiction of a competent court.

Repeat infringers

Come reserves the right to remove access to repeat infringers and to act on clear bad-faith takedown notices.

What is a takedown notice?

A takedown notice is a request to remove content that allegedly infringes your copyright. The DMCA sets the minimum content requirements; the operator (and Come as the editorial surface) honour valid notices.

Where to send it

Send the notice through /contact/; include "DMCA notice" in the subject line. The editorial team acknowledges receipt within the working day.

What happens after receipt

  1. The editorial team logs the notice and reviews the claimed content.
  2. If the notice is valid, the team removes or restricts access to the content.
  3. The team notifies the user who submitted the content (where applicable).
  4. The team retains the notice in case of a counter-notice.

Counter-notice in detail

A counter-notice is a response to a takedown notice. The counter-notice must include:

  • Identification of the material removed and its location before removal.
  • A statement under penalty of per consent that the removal was the result of mistake or misidentification.
  • Consent to the jurisdiction of a competent court.
  • Your name, address, telephone and physical or electronic signature.

Send the counter-notice through /contact/; mark the message "DMCA counter-notice". The editorial team restores the content within 10-14 business days unless the original complainant files a court action.

Repeat infringers

Come reserves the right to remove access to repeat infringers. The editorial team maintains a record of takedown notices and may act on a clear pattern of infringement. Action is independent of jurisdiction; we apply the policy consistently.

Good-faith requirement

Takedown notices must be made in good faith. Knowingly false statements under penalty of per consent may expose the complainant to liability for damages. The editorial team reviews notices for clear indicators of bad faith before acting.
